Free Legal Guidance!

I have some legal questions but do not want to invest any money into a lawyer at this point until I know it is something worth moving forward. Where can I get some basic information for free?

  1. Although there are many lawyers in the area who will give free consultations, it is difficult to know where to begin. A lot of lawyers devote most of their practice to one area of the law. If a particular case does not fall into their practice area, they usually cannot be of much assistance. Sometimes a person needs to talk to a lawyer just to figure out what type of lawyer they might actually need. The Milwaukee Bar Association and Milwaukee Young Lawyer’s Association have teamed up and are offering free walk-in legal clinics on Saturday, April 30th, from 10:30-2:30 pm in honor of national Law Day. The free walk-in legal clinics will be staffed by attorneys and no appointments are necessary. Arrive during the open hours and speak with an attorney at no cost. All areas of law can be addressed. Clinics will be held at the following locations:

    Bay View Library (Spanish speaking)
    2566 S. Kinnickinnic Ave.
    Downtown
    Central Library
    814 W. Wisconsin Ave.
    North Side
    Center Street Library
    2727 W. Fond du Lac Ave.

    If the lawyers at the clinic cannot answer your question, they can at least get you started on being able to solve your problem.

  2. I have a 87 year old mother who took out a $75M mortgage on her house to help her neice. which is a 40 year loan. I am her daughter and didnt know anything about it until a week ago. Can a mortgage company do that? Her house was already paid off.

  4. I am the guardian for my 31 year old son who has been with me since birth. About a year ago,upon referring with my laywer and an attorney on staff with the probate court, I recently relocated to Texas from Wisconsin. I have established guardianship in Texas but am have difficultly closing the file in Wisconsin. Although I have been working with my attorney, whose client I have been since 1996, he has been dragging his feet in filing the necessary paperwork which was mailed to him in a timely fashion. I tried cotacting the probate court in Milwaukee to no avail because information can not be given over the phone and I have pursued and pressured my attorney to follow through with resolving this matter. My concern is that even though I have done what the courts required, I recently discovered I will be held accountable and there could be possible court action against me. I don't know what else I can do, what other recourses do I have.

  6. Hello, a week ago today, I moved into a 4 unit complex apartment building. On the 4th day, I noticed a roach problem. As a result, I notified the landlord of the problem. In short, I would like to vacate from the property. In my lease it says that a 60 day notice must be given. I was told by the landlord that I would have to wait until next month to give my sixty day notice. My question is, is there a time frame in which a tenant has to turn in a notice to vacate? I personally thought 60 days is 60 days? Please give me clarification on this matter?

  9. My mother has dementia and was signed off as being incapacitated. I had medical and financial power of attorney and I admitted her to a private pay assisted living facility. I signed as the responsible person and took care of mom's bills for three months. My sister took my mom from the facility and found another doctor who said she was competent. They did not give the proper thirty day notice and now I am being sued by this facility for the unpaid balance. Nowhere in the contract does it state that the responsible person assumes financial responsibility if the resident does not pay. What are my rights in this matter?

  10. My wife put our liquid community property in her savings, annuity, and brokerage accounts, then she filed for divorce. Is this legal? If not, what needs to be done to obtain enough for my legal expenses? Since I was ordered by the court to pay half of the expenses for our home, would it be proper to have her take what I owe her out of those community funds that she is holding?

    The other possible source of funds is my retirement 457 account. At the first hearing the court commissioner stated that if I used that money it could be considered in contempt of her court order. Is there any way I can address the Court Commissioner with a request to use some of that money for an attorney and other legal expenses? I realize that to the court my attorney is still representing me but in reality this is a pro se case until I can find the money to hire another attorney.

    My attorney is not representing me because the money I had ran out. I thing because I can't find another attorney to take the case without a retainer, she has asked the court to either discharge her from the case, or have me considered incompetent and a Guardian at Litem appointed for me. Her reason being that I didn't follow her advise.

    Her advise was how to run my business which my family has been doing for over 80 years and I have for about 40 years. She has no business law experience and didn't discuss this with any attorney that does, even though I asked her to.

    She spent a good portion of her time and my money trying to prove that one of my investments was a waste of community property. Does it seem strange to you that she spent so much of my limited resources to try and prove a point that could only help my wife’s' case?

    I hired her to negotiate the divorce for me, for which she gave me hardly any help or advice .

    The only other relevant fact is that the court order taken from my financial statement showed that I had $7,000 in expenses per month and $4500 in revenue. The court commissioner stated that if I didn't pay all the expenses I would not be found in contempt of her court order.

Hello, I just recently got a notice from a junk debt buyer (Midland Credit Management) about a credit account that was charged off over three years ago and that I settled with the original credit card company for a percentage. MCM says I'm in "Pre legal Review" and will be sued if I don't send money within four weeks. They are also charging me 5% interest which I can't imagine could be remotely legal? I sent a certified Validation of Debt Letter to them yesterday which was a recommended step from some research I did. I don't have money for an attorney and am afraid to be sued or have random interest accruing on an old settled debt. What can I do to protect myself? This company has a bad reputation from what I've read.

    1. I am also in the same boat with Messler & Kramer law firm who represents "Capital One." They are located in MN, but yet is trying to collect the remainder balance of $1700.00. I sent a validation of debt letter, but all I received in return was when the account opened, when it was charged off, and a credit card agreement stating the terms and conditions of the card. I did not receive any other information in regards to my account as far as account history relating to the balance, any late fees & interest accrued on this balance, the signed credit application, etc. How should I pursue my next step?

  15. My Deceased parents left their money to their 3 grandchildren. Estimated $120k for each child. I am not allowed to see the trust..my estranged sister has complete control (or she just says she does. Recently she told my till she is 21 and more at 25 & 30 yrs old.

    My sister sent a very "direct" letter to dsughter disclosing family secrets and demanding receipts for everything she has used the money for. Also she makes slanderous comments about me to my kids.

    It appears she is not interested in giving the trust to my daughter. She feels that my daughter has terminate the trust by using the money for living expenses my daughter portion of the money until she release another year. She assumes that the money is being misused..my daughter is 20 years old. She is waitressing and has 2 jobs with a full time schedule of 9 credits. She dropped a class that she was failing so when my sister sent this contentious letter requesting a laundry list of expenses.

    Is there any way to see the trust and its stipulations for reimbursing my daughter for school related activities and classroom attendance.I am afraid that my sister is pocketing money for her sons college which is $65k a year - My sister cant pay that so she hit my mom up for the money as I have 2 children so she should get twice the amount as
    her son got only a third...warped thinking...
    I need to asap have a lawyer review the will and trust documents. It is my fear that the whole $300k will be gone by the time my daughter goes back to school (or greatly reduced)Is my sister getting money to mange this trust. Does she have the right to demand specific things that may not be mentioned in the trust? I feel if she needed this documentation she should have made it clear that she has the power to edit, change or terminate the trust ( we feel that she is using it to pay for her sons college. There are no checks and balances in place to monitor the power my parent gave her when she became the Trust admin. It appears that she requires this of my daughter but she can get away with anything she wants/needs. To be fair my daughter lost focus in college so she wants to be a hair stylist. Can you review the letter and trust and will to determine if my sister is "raiding the fund"? And can she just request all this information without it being in the trust?
    My sister vaguely told my daughter in April 2011 that she needed to keep receipts for all school related expenses. She sent a letter slandering me and my exhusband and threatening me that if I got involved she could terminate the entire trust. We are not in a position to pay a lawyer - legal assistance is requested.

  16. My son died June 2010 at his place of employment. OSHA fined the company for things related and unrelated to his death, so I obtained a Workers Comp attrorney, however, because he was unmarried and had no children, there is nothing I can receive except funeral expenses. At the time of his death, he was 19. Also, at the time of my son's death, we though he had a daughter, however, I took a DNA test last week and found out that she isn't. Is there another type of attorney I can obtain? or what can I do?

  17. My mother's father lived in milwaukee and passed away this year. The young man that was living with him claimed to be his son but during the funeral preparations admitted that he was not but that he was considered a son because he grew up around him. Well it turned out this "son" managed to have all financial documents(bank accounts, life insurance, etc..) left to him as the beneficiary all signed and changed within a year of his death. Since I am not a resident of the state of Wisconsin and reside in Illinois and I am a senior citizen, do I have any legal recourse I can take against this fraud and since I do not live there how can I go about obtaining rather inexpensive representation in Milwaukee to capture my father;s assets and possible have this man punished.

  18. In June 2011 I agreed to let my friend move his furniture in my basement and was suppose to move it out by July 2011. Here it is now January and he hasn't move it out yet. What legal action can I take?

  19. Good Morning, I have been separated from my husband for 12 years. 8 out of the 12 years he was in prison and was deported back to his home country in Central America. He has been there for almost 4 years come April. He is filing for a divorce which we both want and is wondering if by filing in Central America will the state of Wisconsin consider me divorced after we both sign the papers.

  20. I am having problems w/ my daughter's school. Because of the lack of particular services, she was hospitalize and now I'm forced to find another school. Bullying is one of the issues at hand and she does have an IEP for depression and ADHD. Another problem is that I work for the same school that she attended and it ills me to know that all this went on w/o providing her with help. I need some legal advice.

  21. I am going through a divorce, my soon to be ex is refusing to pay her share of the student loans that went to living expenses ( 34 K). I am soley responsible for the portion that went to tuition and school related expenses, but I can not responsible for stuff that we took out to spend on home improvment, most of the loans were taken as a graduate student where my tuition was paid for by our department.

  22. I have been married for 23 years but have been separated from my husband for 12 years. He was arrested in 2000 and in 2008 was sent back to his native country in Central America and is not allowed to come back to the states. I have 4 children with him 22 yr old, 21 year old, 16 yr old and a 15 yr old. I have no communication with him and his family has not been able to communicate with him as well. I want a divorce and would like to know how I go about it and will the court grant me the divorce?

  23. I am the beneficiary (wife) of my deceased husband's life insurance policy. The insurance company has told me that it is not going to pay me since it says my marriage is void since my husband was not competent when we got married many years ago. can I sue the insurance company to force them to pay me? what is my deadline to start a lawsuit?
